Overview

Jesenia resolves complex commercial, employment, insurance and intellectual property disputes for her financial services, technology driven, and consumer oriented clients in state and federal courts across the country.

Jesenia excels at counseling individual and corporate clients on the costs and benefits of litigation to resolve their business disputes. She provides realistic assessments of the risks and issues faced by her clients, advises on the pros and cons of proceeding to litigation, and frames the complex issues in play so that her clients can receive the practical guidance needed to make business and litigation decisions. In addition, she often guides businesses and individuals alike on avoiding litigation altogether: how to meet obligations in agreements, how to not breach contracts, how to comply with the Uniform Commercial Code (UCC), and more.

Clients appreciate Jesenia’s detailed-oriented, roll-up-her-sleeves approach. She interviews clients, deposes experts and witnesses, and delves into documentary records to refine her understanding of her client’s position and the legal issues in play. Armed with a facile understanding of the facts and issues in the cases that she handles, she prepares motions and other court documents to serve as an effective advocate on behalf of her clients throughout the life of their dispute. Jesenia also regularly appears before judges for hearings and handles both jury and bench trials.

Jesenia has particular strengths resolving employment law disputes – including contractual, compensation, and discrimination matters – on behalf of both employers and employees. In one notable case, she was an integral part of the team successfully representing a group of terminated senior banking executives who filed a multi-million lawsuit against their former employer over compensation.

Jesenia is actively involved in pro bono work on immigration, criminal law and other issues.  She has obtained asylum for ten individuals, worked with the Innocence Project to submit an amicus brief to the U.S. Supreme Court in a highly publicized criminal matter, and been recognized for her efforts by the City Bar Justice Center, Sanctuary for Families, and The Legal Aid Society.

  • Handled insurance coverage matters for company facing thousands of claims arising from largest oil spill in U.S. history.
  • Represented senior banking executives in a multi-million dollar dispute related to their compensation during a lengthy jury trial.
  • Represented a fintech company in connection with a dispute with its former CEO during a three-week arbitration.
  • Prosecuted $30 million patent infringement claims against major telecommunications companies.
  • Prosecuted $40 million breach of contract and fiduciary duty claims on behalf of a publically traded company against a former executive.
  • Successfully defended a Fortune 500 company at trial regarding a $17 million claim that it breached the covenant of good faith and fair dealing.
  • Represented the Audit Committee of the City of San Diego in an investigation of issues related to the integrity of the City’s pension system and financial reporting.
